Policy
: It has always been Flavour of Galloway's policy to treat our customers in exactly the way we like to be treated ourselves. Our toes curl at the sight of small print, but it appears that not only to add to our credibility, but to comply with new legislation (EC Distance Selling Directive) we are required to offer you our own 'large print' version. Call us and we will mail it to you. You should note that your statutory rights under the current consumer protection laws are not affected (more probably enhanced).
Data & Privacy: The information collected from you at the time you place an order (for you or those you wish to send a gift to) will be stored in our database and is used purely to carry out your instructions and action your payment. There are NO circumstances under which this information might be passed to a third party. We are bound by the Date Protection Act and take our obligations under this piece of legislation very seriously.
Supply: We undertake to supply you with the goods described in these WebPages or in our brochure on the date that is agreed at the point of order. If you have an urgent order it is always advisable to discuss your requirement on the telephone 01581500245. Our baskets are generally always available for immediate dispatch; those with a shorter keeping life may not be. We reserve the right to subsitute any item within a basket or the basket itself for something of a similiar nature and quality. Please remember we work with many artisan suppliers who are reliant on the British Seasons and weather for their core ingredients!
Delivery: You, the customer, will obviously recognise that we do rely on The Royal Mail's postal service, and TNT to perform the 'contract'. We monitor the performance of our carriers continuously. If goods do not arrive within the requested time, due to circumstances beyond our control, we will do all that we can to 'chase' up the courier and if the goods are found to be 'lost' then we will offer the immediate dispatch of a replacement parcel, providing the selected goods are available for dispatch.
We cannot be held responsible for late arrival of your parcels due to the weather. This is 'an act of God' and as such we have not yet found a way to control! All of our delivery dates are a guide and although we aim to deleiver in a timeley fashion these acts of God may mean that your parcel cannot get thorugh despite our best efforts. We hope that our customers will undertsand this and will appreciate that we do our best.
If you or your recipent is not in and therefore the product is not signed for then we reserve the right to charge you a restocking fee of £12.50 per delivery. By purchasing from us you are accepting that this fee can be charged.
Guarantee: In light of the above you will appreciate we feel confident that we can unequivocally guarantee your total satisfaction with our product and service. Again you should note that your statutory rights under the current consumer protection laws are not affected (more probably enhanced).
Refunds: In the event of proved loss or dissatisfaction with the product supplied and a replacement is not acceptable or available , a full refund of the item/s will be sent. The goods need to be returned, and any labels from the packaging might be helpful in resolving any tracking issues we might have with a courier etc (unless required by Royal Mail or our Couriers for their investigations). We do not cover the cost of the return postage. If initial payment was by Credit Card, then the refund will be made back to your Credit Card Company. If, however, payment was by cheque, then the refund will be posted to you by cheque within 60 days. Our major concern is to maintain our happy relationship with you, our customer. If the goods ordered were a gift to a third party, the parcel is sent not only with your message but a note (and SAE) asking them (your giftee) to contact us immediately if they feel the goods are not in perfect condition. We hope that we will be able to rectify the problem without any fear of embarrassment to you. We feel this is what you, the donor, would want us to do on your behalf.
Payment: This is through PayPal, cheque by post or visit us and we can take cash! The PayPal pages explain all of the process of how and what to do. If you prefer, you can pay over the phone and we will take payment accordingly by credit or debit card. Vat is chargeable on certain standard rated items contained within our baskets and within our pic 'n' mix section. The price that you see is the price that you pay.
Complaints: Clearly we will take any complaint very seriously and would expect to contact you almost by return - but at Christmas time this might lead to a delay of 24 hours. It is an all hands on deck (parcel packing) scenario at this time of year.
Law and Jurisdiction: Any contract for your purchase from Flavours of Galloway is governed by, and has to be interpreted under the Law of Scotland, and you agree that such contract will be subject to the non-exclusive jurisdiction of the Scottish courts.
(Sorry, have struggled to find more sympathetic wording on this point without success, I fear)
